KPMG Law Ukraine defended one of the largest suppliers of food, sugar, spices and coffee

The KPMG Law Ukraine team defended the interests of one of the largest suppliers of food, sugar, spices and coffee in the dispute with the tax authority on the additional charge of value added tax.

Lawyers of the KPMG Law Ukraine practice of tax dispute resolution refuted the conclusion of the Act of tax audit at the stage of administrative appealing that the reference-calculation of cost of services has all features of the primary document, and therefore the date of its execution is supposedly the date of occurrence of VAT liabilities in transactions related to provision of services to non-residents.

As a result, the State Tax Service of Ukraine confirmed that tax notice-decisions are illegal and contrary to the norms of tax legislation, and the сompany lawfully accrued VAT liabilities as at the date of the acts of acceptance of services.

The project was implemented under the leadership of Konstantin Karpushin, partner, head of the transfer pricing and tax dispute resolution group, Larysa Antoshchuk, attorney-at-law, head of tax dispute resolution practice. KPMG Law Ukraine attorneys Yana Bazia and Andriy Kachkovskyi also worked on this project.
