Specialists of KPMG Law Ukraine successfully defended the interests of a leasing company

KPMG Law Ukraine successfully represented the interests of a subsidiary of one of the largest international corporations providing car-leasing services in a litigation with tax authorities regarding company’s obligation to be registered as a taxpayer of fuel excise.

Within the court trial, tax dispute resolution team proved that individual tax ruling provided by State Fiscal Service of Ukraine contradicted provisions of Tax Code of Ukraine. In the course of legal proceedings, our specialists succeeded in refuting the conclusions of the fiscal authority that the company should register as an excise taxpayer in transactions where the company provides fuel smart cards to lessees. As a result, the individual tax ruling was cancelled by the court decision that allowed the company to minimize potential tax and legal risks.

The engagement was managed by Oksana Olekhova, Partner, Tax and Legal Department, and Larysa Antoshchuk, Attorney, Head of Tax Dispute Resolution Practice. Iryna Khyliak, Yana Bazia, and Vladyslav Kepko, lawyers at KPMG Law Ukraine, were also involved in the engagement.
